Court of Appeals Victory

Today the Washington State Court of Appeals, Division One, gave Summit clients, Nikolay Belikov and R-Amtech International, Inc., another victory. The Court affirmed a court-approved settlement that dismissed the opposing parties’ appeal of judgments against them. The judgments followed a month-long trial in 2014 and ordered the return of technology licensing rights and real estate, and awarded $4 million in monetary relief. The Court also rejected the opposing parties' attempt to extract $125,000 in homestead rights that they failed to raise in the trial court until after the settlement was approved and after the opposing party had offered the real estate at issue as security for a temporary stay.

This decision effectively precludes the judgment debtors from reviving their prior appeal and ensures that Summit’s clients can retain the assets recovered in the lawsuit. Summit's appeal team, as well as trial team, was led by Larry Locker, Maureen Mitchell and Phil McCune.
