Federal RICO Claims and HOA Lawsuit Dismissed

Jessica Goldman successfully defended the Lummi Island Scenic Estates Community Club and its Board members in a federal racketeering lawsuit. Thirty homeowners filed a 66-page complaint in the U.S. District Court for the Western District of Washington asking the Court to rule that the homeowners’ association’s authority had expired pursuant to the language of plats filed in the 1960s, and to dissolve the HOA. Over the course of two years, the Court granted five dispositive motions filed by Summit Law Group on behalf of the defendants, reaffirming the HOA’s continuing authority to govern the community and dismissing dissolution, RICO, breach of fiduciary duty, consumer protection, fraud, unjust enrichment, and civil conspiracy claims. The Court granted the defendants’ final summary judgment motion and issued judgment for the defendants on December 13, 2016.
