Victory in the Court of Appeals!

In an Opinion dated November 22, 2016, the Washington State Court of Appeals, Division II, upheld a trial court order dismissing all claims asserted by a former police sergeant against the City of Lakewood, the Lakewood Police Department, and the former Chief of Police. The Court of Appeals held the plaintiff’s claims of disability discrimination and retaliation were barred by the two-dismissal rule of CR 41(a), while the other claims were conceded by the plaintiff while on appeal. The Court of Appeals’ opinion ends litigation that has taken five years to resolve, including appearances in both state and federal courts.
