Profile Introduction

Polly's practice emphasizes regulatory counseling, contract negotiations and administrative law. Her experience ranges from general land use representation for commercial and industrial development projects to regulatory counseling and advocacy for utilities, solid waste and hazardous waste activities. Her work includes all aspects of the State Environmental Policy Act, including review and preparation of environmental documentation for a variety of projects, as well as litigation of subsequent appeals. Polly has particular expertise in working with local jurisdictions and state regulatory resource agencies, including most particularly the Department of Ecology and the Washington Utilities and Transportation Commission. She has participated in adjudications and hearings before many local governments and before several state administrative tribunals, and has taken several matters through appeals to the Washington State Supreme Court.
 


Representative Cases/Matters

  • Approval for statewide expansion of biomedical waste collection service throughout Washington (Waste Management of Washington, Inc.).
  • Regulatory permits and approvals for operating a municipal solid waste landfill in Southwest Washington, including documentation under SEPA (Cowlitz County).
  • Land use permitting and other regulatory approvals for expansion of a municipal solid waste landfill in Central Washington, including documentation and litigation under SEPA (Waste Management of Washington, Inc.).
  • Rate-setting and regulatory compliance for several solid waste collection companies regulated by the Washington Utilities and Transportation Commission (Sanitary Service Company, Inc. and Waste Management of Washington, Inc.).
  • Acquisition negotiation for purchase and sale of real properties and operating assets of various utility projects (CDM/Phillips-ToltWater Treatment Facility, Bainbridge Disposal, Inc., Cowlitz County).
  • Remediation of hazardous waste contamination and brownfields development of real property in the Puget Sound area (Weyerhaeuser Company, DuPont de Nemours, Inc., Ambaum Station LP).
